पंजाब और हरियाणा उच्च न्यायालय ने हरियाणा सरकार को उन कर्मचारियों से पेंशन की Commutation राशि वसूलने से रोक दिया है, जिन्होंने 10 साल की सेवानिवृत्ति पूरी कर ली है। अब तक, राज्य सरकार यह राशि 15 साल तक पेंशन से वसूल रही थी। उच्च न्यायालय का यह फैसला न केवल पेन्शनधारको के लिए एक राहत है, बल्कि भविष्य में सेवानिवृत्त होने वाले कर्मचारियों के लिए भी एक महत्वपूर्ण उदाहरण हो सकता है।
न्यायाधीशों का निर्णय
न्यायमूर्ति संजीव प्रकाश शर्मा और न्यायमूर्ति सुदीप्ति शर्मा की खंडपीठ ने यह आदेश 71 वर्षीय सेवानिवृत्त कर निरीक्षक शाम सुंदर और हरियाणा सरकार के विभिन्न विभागों से सेवानिवृत्त अन्य पेंशनभोगियों द्वारा दायर याचिकाओं की सुनवाई के दौरान पारित किया। खंडपीठ ने हरियाणा के मुख्य सचिव और महालेखाकार (लेखा एवं परीक्षक) को नोटिस जारी कर 21 अगस्त 2024 तक इस मुद्दे पर जवाब मांगा है।
याचिकाकर्ताओं की मांग
याचिकाकर्ताओं ने वसूली पुरी होने पर पूर्ण पेंशन बहाल करने का निर्देश मांगा। खंडपीठ ने आदेश में स्पष्ट किया किे आगे की वसूली स्थगित रहेगी। हमने कई मामलों में वसूली नहीं करने के लिए अंतरिम आदेश पारित किया है, यह निर्देश उन पेन्शनधारको के लिए लागू होगा जिन्होंने 10 साल या उससे अधिक की सेवानिवृत्ति पूरी कर ली है।”
याचिकाकर्ताओं ने हरियाणा सिविल सेवा (पेंशन) नियम, 2016 के नियम 95 और 106 को अवैध ठहराते हुए निरस्त करने की मांग की, क्योंकि ये नियम राज्य को अनुचित लाभ पहुंचा रहे थे। याचिकाकर्ताओं ने अपनी पूरी पेंशन तुरंत बहाल करने का निर्देश भी मांगा, क्योंकि Commutation पेंशन की राशि 11.5 वर्षों में वसूली जा चुकी है और इसका उद्देश्य पूरा हो चुका है।
याचिकाकर्ताओं ने दावा किया कि पेंशन की समायोजित राशि के लिए 15 वर्षों की अवधि अनुचित है, उन्होंने यह भी कहा कि 15 वर्षों की अवधि का कोई ठोस आधार नहीं है और यह केवल राज्य को अतिरिक्त लाभ पहुंचाने के लिए बनाई गई है।
याचिकाकर्ताओं के वकील का तर्क
याचिकाकर्ताओं के वकील, एडवोकेट विकास चत्रथ ने तर्क दिया कि राज्य सरकार 8.1% वार्षिक ब्याज दर के साथ 15 वर्षों (180 किस्तों) में Commutation पेंशन की अतिरिक्त राशि वसूल रही है, जबकि यह राशि 11.5 वर्षों (लगभग 135 किस्तों) में वसूल हो चुकी है। चत्रथ ने तर्क दिया किे “यह अनुचित लाभ के समान है क्योंकि रेस्टोरेशन की अवधि को 12 से बढ़ाकर 15 वर्ष करना, राज्य कर्मचारियों को केंद्रीय सरकारी कर्मचारियों के समान बनाने के लिए, संविधान के अनुच्छेद 14 और 16 का उल्लंघन करता है, क्योंकि राज्य कर्मचारी 58 वर्ष की आयु में सेवानिवृत्त होते हैं, जबकि केंद्रीय सरकारी कर्मचारी 60 वर्ष की आयु में सेवानिवृत्त होते हैं,”
याचिकाकर्ताओं के वकील ने अदालत को किया सूचित
अदालत को सूचित किया गया कि हरियाणा सिविल सेवा (पेंशन) नियम, 2016 के नियम 95 का निरीक्षण करने पर पता चलता है किे 15 वर्ष की अवधि का निर्धारण उचित नहीं है क्योंकि इसका कोई आधार नहीं है। यदि पेंशनभोगी अवधि से पहले मर जाता है, तो राज्य को कोई नुकसान नहीं होता है क्योंकि पारिवारिक पेंशन सेवानिवृत्ति या मृत्यु के समय अंतिम वेतन का 30% देय हो जाती है।
याचिकाकर्ताओं के वकील ने तर्क दिया कि राज्य कर्मचारी 58 वर्ष की आयु में सेवानिवृत्त होते हैं, जबकि केंद्रीय कर्मचारी 60 वर्ष की आयु में सेवानिवृत्त होते हैं। यह अंतर पेंशन की गणना और समायोजन में महत्वपूर्ण भूमिका निभाता है। राज्य कर्मचारियों पर केंद्रीय कर्मचारियों के समान नियम लागू करना अनुचित है और इससे उन्हें वित्तीय नुकसान होता है।
हरियाणा सरकार की प्रतिक्रिया
हरियाणा सरकार को मुख्य सचिव और महालेखाकार (लेखा एवं परीक्षक) के माध्यम से अदालत में जवाब दाखिल करने के लिए कहा गया है। सरकार को यह स्पष्ट करना होगा कि 15 वर्षों की अवधि क्यों तय की गई और यह क्यों आवश्यक है। सरकार के जवाब पर अदालत की अगली सुनवाई पर विचार किया जाएगा, जो 21 अगस्त को निर्धारित है।
निर्णय का व्यापक प्रभाव
यह आदेश न केवल हरियाणा राज्य में सेवानिवृत्त कर्मचारियों के लिए महत्वपूर्ण है, बल्कि यह अन्य राज्यों में भी इसी तरह के मामलों के लिए एक नजीर बन सकता है। यदि उच्च न्यायालय इस मामले में याचिकाकर्ताओं के पक्ष में अंतिम निर्णय सुनाता है, तो यह अन्य राज्यों को भी अपने पेंशन नियमों की समीक्षा करने के लिए प्रेरित कर सकता है।
सेवानिवृत्त कर्मचारियों के लिए राहत
इस आदेश से उन लाखों सेवानिवृत्त कर्मचारियों को राहत मिलेगी, जिन्होंने 10 वर्षों से अधिक की सेवानिवृत्ति पूरी कर ली है। यह उनके आर्थिक बोझ को कम करेगा और उन्हें वित्तीय स्थिरता प्रदान करेगा। इसके अलावा, यह राज्य सरकार को अपने पेंशन नियमों की समीक्षा और सुधार करने के लिए मजबूर करेगा, ताकि भविष्य में किसी भी कर्मचारी को अनुचित वित्तीय बोझ न उठाना पड़े।

Is this decision applicable to pensioners of Bihar Govt.
It was also discussed in the meeting and Govt. has shown cold shoulder towards this case. Actually govt. Is interested in troubling retired employees when Courts directed not to deduct amount after 11 years then why govt. Is not passing such order to provide relief to retirees. The present despensation at centre should reconsider the case on priority to facilitate retirees.

Dear all, What about the recovery made beyond ten years ? Nobody has mentioned the excess amount recovered after ten years. If judgement received positive, the recovery made beyond ten years may please be refunded to the pensioners. In this regard cut-off date and year may please be decided by the court only.

The center govt. Should decide it for all India pensioners. This dispute will be resolved for all India pensioners. This is due to huge drop in the interest rates hence justified.

I JC 740995 Sub Narsanna retired on 31 May 2008. My commutation @Rs5985/pm started from 01 Jun 2008 to 31 May 2024 (16 years completed). Commutation deduction is still continue upto 2027 as under
a. Rs 2255 till 03 Dec 2024
b. Rs 585 till10 feb 2028
Desuction done for one more year should be refunded and deduction of abobe mentioned amount in para a and b should also stopped immediately

Dopt should issued Gernal order convey to retired employee of central government and state govt employees beneficiary. It exploitation of retire employee . The commutation amount should be recovering as per correct calculation of interest i.e. 10 year.. Now the bank interest has reduced lover side the recovery of commutation based on interest and period .The illegally recovery for 15 year instead of 15 years

I’m ex-Subdar Jaspal Singh retired on 30 September 2008 and on pension from 1st October 2008 commutation 15 years completed on 30 September 2023, so that commutation amount still not restoration. I already put a grievance on sprash portal still not any answer. What i do.

Senior citizen should get medical and other health benefits from the Government of India as the benefit of rail fare, lower berth allotment etc. They have been deprived of these benefits since 2 yrs back while govt. should notice that there is a large no. of such people. Although all political leaders are getting such types of benefits. And they never reduce or scrutinize there policies of benefits. They travel in planes,railways without spending a single pie.
